Half Price Books Files Lawsuit against Barnes & Noble

Half Price Books filed suit in the U.S. District Court, Northern District of Texas, Dallas Division charging Barnes & Noble.com, LLC with trademark infringement. The suit asks the court to stop the company from using "Half-Price Books" in online advertising and on an area of its web site that was previously called "Bargain Books."
Company President and Chief Executive Officer Sharon Anderson Wright said that the misuse of her company's name has caused confusion about whether Half Price Books has been purchased by the defendant or entered into some form of relationship with it to sell books. An additional concern is that the confusion caused by Barnes & Noble.com's use of Half Price Books' name on its Web site could result in customers mistakenly purchasing books from the defendant's Web site, when in fact they intended to make their purchase from Half Price Books' Web site.
"We've taken this action after Barnes & Noble.com site administrators refused our requests that they remove our name from their website to eliminate the confusion that it is causing," Wright said.
Founded in 1972, Half Price Books said it is the nation's largest family owned new and used book company with 75 locations in 11 states and an e-commerce division. The company sells new and used books, magazines, comics, records, cassettes, videos, CDs, DVDs and collectible items. Except for collectibles and specially priced promotional items, all goods are sold at half the publisher's price or less.
