eBay Revising User Agreement in UK

eBay UK is revising its User Agreement effective January 8, 2004. Here's a rundown of some of the major changes as announced by eBay. Users should read the full text of the user agreement, however.

Use of Passwords. We have clarified the wording in paragraph 2 to make it clear that all users should take keep their passwords safe from disclosure and should not disclose their passwords to any other person.

Feedback. We may limit the number of bids and listings users may place on the Site and other activities on the Site based upon the user's feedback level. For example, to sell with Buy It Now, you must have either a minimum feedback rating of 10 or be signed up for Direct Debit.

Listing Description. We have added provisions to deal with an increasing number of listings that contain irrelevant content or that are listed in the wrong category, as this detracts from the vibrancy of our marketplace. For example, you must describe your item and all terms of sale on the listing page of the Site and you are responsible for ensuring that you have the right to use all content in your listings.

Fraud. Due to the importance of this issue to the eBay community, we have strengthened our ability to deal with users that we suspect are acting fraudulently.

Fees. We have clarified that from time to time we may amend the fees we charge you, for example during promotional events, and we will tell you about this beforehand.

Access and Interference. We have strengthened the provisions relating to unauthorised access or use of our website.

Your Use of Other Users' Information. Due to the importance of ensuring that all users in the eBay community respect each other's privacy and personal information, we have included the obligations on all users from our Privacy Policy into the User Agreement, which means that they are now legally binding obligations.

Your liability. We have amended the limitation of our liability to our users to be the greater of (a) the total fees you have paid to us in relation to the listing or other service offered giving rise to liability, and (b) £100. We believe that this is more reasonable.

Arbitration. We deleted the provisions relating to arbitration as we will make every effort, where possible, to resolve issues without the need to use formal procedures.
