Reading AuctionBytes: Anti-Counterfeiting Group Urges Overturning of Tiffany-eBay Ruling

The International Anti-Counterfeiting Coalition (IACC) announced it has filed an amicus brief with the United States Court of Appeals for the Second Circuit in support of Tiffany's appeal in its lawsuit against eBay. The brief states that the Court should hold eBay contributorily liable for failing to prevent illegal sales of counterfeit and infringing goods on its site.

The IACC's brief was filed in connection with the lawsuit filed in 2004 by Tiffany and Company and Tiffany (NJ), Inc. against eBay for trademark violation and on which the United States District Court for the Southern District of New York ruled in July 2008, which Tiffany is appealing.
