You would be covered under the First Sale Doctrine and Fair Use Doctrine.
However that doesn't stop either a VeRO member or eBay shutting you down.
You just have to be prepared and know your rights. |

My fear has come to pass. After listing 3 new in the box Coach rain boots, I got the following restriction message when trying to revise a listing:
Attention Seller:
Thank you for choosing eBay.
In order to help maintain a safe trading environment, selling limits are occasionally placed on listings. At this time, you are limited in the number of certain items you may list and/or revise in a 30 day period.
Sellers who have built a long-standing and consistent positive history of selling items may be eligible to have their selling limits raised. If you believe that you would qualify, please click http://pages.ebay.com/sell/selling-restrictions.html for more information.
We sincerely value you as a member of our trading Community and look forward to a continued successful relationship with you.

I've email eBay customer service but it takes at least 24 - 48 hours. Selling winter boots is time sensitive.
I meet all these requirements from the above URL:
"5. May I get the selling restrictions removed from my account?
Sellers who have a good track record on our site and are confident in the authenticity and origin of their items may be eligible to have their selling limits increased. Our considerations for determining whether to increase selling limits include, among other factors:
* Positive buyer feedback
* No unresolved disputes with buyers
* Selling history (minimum three months) and activity as a seller on the site
* Absence of feedback concerning the authenticity of the item(s)
* PayPal verified
* Compliance with eBay policies
* General good standing of the account"
Any advice? If and when eBay lifts the restriction in days, winter will be over and the boots will not sell well. _________________ Linda

That was not a VeRO takedown. That was eBay doing the listing restrictions for high end brand name products.
They are doing that to a lot of people. If you end up continuing to list brand name items you will run into this again. |

Once again, you were not shutdown by the rights holder. You were shutdown by eBay restricting sellers for high end items.
And the First Sale Doctrine in your listing isn't going to stop a VeRO member who doesn't want their items sold on eBay. |
